Terms & Conditions

Neither the carrier nor the ship shall be liable for any loss of life or personal injury that may occur at any time and at any place when the passenger has boarded, is ashore, whilst at an intermediate port, either after disembarking at the final port. For such events which take place on board the ship, the carrier is liable only if the interested party shall be able to prove that this event was caused due to gross negligence of the carrier or his employees.

The carrier is not liable for the loss or damage of private property, such as cash, jewelry, decorative items, tools, computers, works of art or other valuables, unless these were handed over to the carrier specifically for reasons of safekeeping. Even in such cases, the carrier’s liability shall be limited to due compensations provided for in the Athens Convention.

We recommend that women in the early stage of pregnancy, up to the 12th week, seek medical advice before traveling. Women who have completed or will complete the 28th week of their pregnancy at any stage of the cruise should present a medical certificate confirming their fitness, i.e. ability to travel. The carrier reserves the right to request a medical certificate at any stage of pregnancy and to refuse transportation should the carrier and/ or the captain show any doubt that the passenger shall be safe during the cruise.

The passenger must not carry on board any illegal drugs or other illegal items, such as knives, guns, weapons of any kind, flammable or hazardous objects, nor any other prohibited substance. Not complying with the rules constitutes a violation of the present terms and renders the passenger strictly liable towards the carrier for any injury, loss, damage or expense, thus the passenger shall be liable to compensate the carrier for any claim, fine or financial penalty arising from this breach (including but not limited to legal costs or other expenses relating to the treatment of such claims or carrying out procedures relating to the imposition of fines or penalties on the basis of full compensation). The passenger may be liable to statutory fines or other sanctions. The captain (or any other competent officer) has the right at any time and without notice, to enter and/ or investigate the cabin, the baggage (whether inside or outside the cabin), any other items belonging to the passenger or to conduct a physical search on the passenger and the passenger hereby consents to such entry and search.

All firearms and any other weapon of any kind are prohibited on board. The captain and/ or the carrier shall be entitled to confiscate, retain, or take any other measures in relation to such weapons. Those persons carrying or handling such objects may have to disembark without any further liability of the carrier.

In order to ensure that the carrier is able to carry passengers safely and in accordance with applicable safety requirements imposed by international, European or national law and in order to comply with the safety requirements imposed by the competent authorities, including the administration of the state flag the passenger declares and guarantees that he/ she is mentally and physically fit to travel and that his / her behavior shall not endanger the safety of the ship nor he/ she shall harass the other passengers.

Any Passenger with mental or physical disability of any kind or with symptoms of mental or physical illness of any kind, which may affect his/ her ability to travel, must present a medical certificate before the ship’s departure certifying the ability of the passenger to travel.
In case of illness or accident, passengers may be transported ashore by the carrier or the captain for medical care. The carrier assumes no liability as to the quality of medical care in any port or place of disembarkation of the passenger. Passengers are advised to take out an insurance policy covering medical care and emergency airlift or other means of returning to their home. The carrier does not undertake any liability for medical facilities ashore. The medical facilities and standards of care vary from port to port. The carrier therefore makes no statement, nor guarantee of the quality of medical care received ashore.

The ship’s operation depends on the weather conditions, vessel traffic, Government interventions, the obligation to assist other ships in distress, the availability of berthing facilities, unusual and/ or unforeseen circumstances or circumstances which could not have been predicted or are cancelled and/ or other factors beyond the carrier’s control. The carrier may deviate from its course, restrict, cancel, postpone or terminate the cruise at any time before or after having sailed for any reason regardless of whether the ship has deviated from its course or not.

The carrier may at any time deviate, restrict, cancel, postpone or terminate any cruise
(i) if its execution or continuation is impeded or blocked for reasons beyond the carrier’s control, or
(ii) if the carrier’s captain considers that the termination of the cruise is rendered a must for operational purposes of the ship or the carrier.
Should the cruise be cancelled, postponed, curtailed, delayed or terminated by the carrier for any of the reasons referred to in clause 22, neither the carrier nor the Organizer shall bear any liability towards the passenger. Should the cause for the above be unusual or unforeseeable or the circumstances could not have been foreseen or cancelled, then neither the carrier nor the Organizer shall bear any responsibility towards the passenger.

The carrier does not guarantee that the ship shall approach all advertised ports of call nor that it shall follow a specific sea route or time schedule. The captain and the carrier shall have the absolute right to alter or replace the advertised program or ports of call for any reason.

The carrier shall not have any liability for any loss or injury, damage, or inability to perform the cruise as a result of any circumstances of force majeure including – but not limited to – war, terrorism (actual or imminent), fire, natural disasters, acts of God, labor strikes, bankruptcy, failure of contractors to perform, any other events beyond the carrier’s control or any events that are unusual or unexpected.

Should the ship be hampered or blocked for any reason, thus obliged to leave or not able to continue its predetermined route, the Carrier is entitled to transfer the passenger either to any other vessel, or upon his consent to any other means of transport, going in the direction of the passenger’s destination.

The passengers should abide by the ship’s departure times at each port. Should any passenger miss the ship at any of the ports listed in the cruise’s itinerary, the carrier shall in no case be liable for such an event, nor shall they be held responsible for the passengers’ alternative transportation.

The carrier does not accept unaccompanied minors under the age of 18 on the date of departure and children are not permitted to board the ship without being accompanied by a parent or guardian. While on board children must remain under the supervision of a parent or guardian at all times and are welcome to take part in the activities on board or in land excursions as long as a parent or guardian is present. Children are not allowed to remain on board the ship should the parent or guardian go ashore.

The passenger agrees to comply with the corporate standards and regulations of the carrier as well as all the commands and instructions of the ship’s captain and officers.

No animals and/ or pets are allowed on board, with the exception of animals certified as escort aids for the blind.
Any kind of expenditure, including fines, penalties, fees, or other charges incurred by the carrier deriving from the passenger’s failure to comply with the ship’s rules or regulations or regulations of any Government or other authorities, shall be paid in full by the passenger to the carrier as soon as called for.
Every disagreement and issue by any means raised between the passenger and the carrier with regard to the transfer, including, without limitation, the execution of the transportation and the implementation of these terms, shall be governed by the Greek law and shall be subject to the provisions of the Athens Convention and shall be heard before the Courts of Piraeus, Greece, unless the carrier concurs otherwise expressly and in writing.

SAFETY REGULATIONS
“ATHENS DAY CRUISES” safety procedures are fully harmonized and certified by the Greek Shipping Authorities which are in full compliance with the International Ship Management Code.
Furthermore, following the regulations of the Greek Coast Guard, all officers and personnel must pass examinations on training on emergency procedures such as fire, sea rescue, evacuation procedures, dealing with marine disasters etc.

On every departure, announcements are made informing passengers on the ship’s safety regulations, the safety procedures as well as information and additional advice.
Safety instructions are also located in prominent locations and central points of each ship.
For additional information, passengers may contact the ship’s officer or the reception desk.

PASSENGERS’ OBLIGATIONS
The passenger shall be liable and shall indemnify the carrier for every damage to the ship and/ or in its annexes or equipment or any other property of the carrier, caused by any wrongful or negligent act or omission of the passenger or any other person under the responsibility of the passenger, including but not limited to minors under 18 years old traveling with the passenger.

The carrier reserves the right to request a medical certificate at any stage of pregnancy and to refuse transportation should the carrier and/ or the captain be unconvinced that the passenger shall be safe during transport.
Any Passenger with mental or physical disability of any kind or with symptoms of mental or physical illness of any kind, which may affect his/ her ability to travel, must present a medical certificate before the ship’s departure certifying the ability of the passenger to travel.

Any kind of expenditure, including fines, penalties, fees, or other charges incurred by the carrier deriving from the passenger’s failure to comply with the ship’s rules or regulations or regulations of any Government or other authorities, shall be paid in full by the passenger to the carrier as soon as requested.

LOST ITEMS
Should you find out that you have lost any personal belongings during the cruise, please inform the ship’s officer immediately.
All lost items which shall be found on board the ship after the cruise, shall be transferred to the headquarters of “ATHENS DAY CRUISES”.

PRICE TERMS
“ATHENS DAY CRUISES” reserves the right to change, whether via an increase or decrease, any published rates, without prior notice. We reserve the right to impose on any existing booking or new bookings (whether paid in full or not) a supplement for fuel or other matters without prior notice. In addition, we reserve the right to transfer to any third party imposed fuel or other surcharges, also without prior notice. The guest will remain liable for any applicable taxes, fees or surcharges that may be assessed by any governmental or quasi-governmental agencies.

CANCELLATION POLICY
– A 100% refund or conversion to an open ticket available at any date till the end of the year, is valid for cancellations up to 30 days prior to departure
– 25% of the total reservation price is charged for cancellations between 16-29 days prior to departure
– 50% of the total reservation price is charged for cancellations between 8-15 days prior to departure
– 75% of the total reservation price is charged for cancellations between 6-7 days prior to departure
– There are no refunds for cancellations up to 6 days till the departure day
